Who we are
nojau is a technology company that develops and operates a conversational commerce platform offered under the Software as a Service (SaaS) model.
Our platform helps companies strengthen their commercial and communication processes through tools that allow them to automate conversations, manage user interactions, incorporate artificial intelligence and facilitate digital experiences through messaging channels such as WhatsApp.
In these terms:
- "nojau", "we" or "our platform" refer to the service provider.
- "Client" is the natural or legal person that contracts one or more services from nojau.
- User is any person authorized by the Client to use the platform or interact with its services.
- Services corresponds to the solutions offered by nojau.
Usage license
nojau grants the Client a limited, non-exclusive, non-transferable, revocable license subject to these Terms and Conditions to use the platform and the contracted services.
The granted license only authorizes the use of the platform and does not imply the sale of the software, source code, technological developments or associated intellectual property rights.
The platform and its services
nojau offers a platform composed of different services that can be implemented independently or jointly, according to the needs of each Client.
Among the services that nojau can offer are, among others:
nojau may incorporate, modify, update or withdraw features and services as part of the natural evolution of the platform, seeking to inform in a timely manner when such changes have a relevant impact on the provision of contracted services.
- Standard broadcasts: tools to create, manage and run communication campaigns via WhatsApp, using segmentation, scheduling and templates.
- conversational commerce solution that facilitates shopping experiences through features such as landing page shopping carts or carousel carts.
- Conversational agent: artificial intelligence-based service designed to automate conversations, answer queries, assist users, support commercial processes and execute conversational flows using the information provided by the Client.
Registration and access
Access may require the creation of accounts by nojau, the Client or through other authentication mechanisms enabled by the platform.
The Client is responsible for managing the access granted to its Users, keeping the information provided up to date and protecting the credentials used to access the platform.
Each User will be responsible for the activities carried out from their account.
Permitted use
nojau services must be used only for legitimate purposes and in accordance with applicable law.
Prohibited use
It is not allowed to use the platform for:
- Carry out illicit activities.
- Send fraudulent, misleading content or content that infringes third party rights.
- Distribute malicious software or attempt to breach platform security.
- Access information, accounts or systems without authorization.
- Copy, modify, distribute, sublicense or perform reverse engineering on the platform.
- Use the services in a way that violates the policies of external technology providers.
Third-party integrations
The platform can be integrated with third-party technology services, including messaging providers, artificial intelligence, payment systems, e-commerce platforms, and other business tools.
The operation of such integrations will depend on the availability, conditions and policies established by each provider.
nojau does not control the decisions, technical changes, restrictions or interruptions of services provided by third parties and will not be responsible for the effects that such circumstances may generate.
Artificial Intelligence
Some services incorporate artificial intelligence models to assist commercial processes, automate conversations or generate content.
The responses produced by these models may contain inaccuracies, errors or omissions and do not replace the professional or commercial judgment of the Client.
It is the Client's responsibility to review and validate the information when its nature so requires.
Personal data
nojau processes personal information in accordance with applicable law and its Personal Data Processing Policy.
When the Client uses the platform to manage third-party personal data, it will be responsible for obtaining the corresponding authorizations and complying with the obligations that correspond to it as the data controller.
Confidentiality
Both nojau and the Client may have access to confidential information during the provision of services. Each party undertakes to use such information solely for the execution of the commercial relationship and to adopt reasonable measures to prevent its disclosure.
Intellectual property
The platform, its software, technological developments, designs, trademarks, documentation, content and other elements that comprise it are the property of nojau or their respective owners and are protected by intellectual property law.
No provision of these Terms and Conditions transfers ownership rights over the platform to the Client.
Suspension or termination
nojau may suspend or limit access to the platform when there is a breach of these Terms and Conditions, security risks, legal requirements or any circumstance that compromises the proper provision of services.
The Client may terminate the use of the services in accordance with the conditions agreed between the parties.
Limitation of liability
To the maximum extent permitted by applicable law, nojau will not be liable for indirect damages, loss of income, loss of information, business interruption or decisions made by the Client based on information generated by the platform or by third-party services.
nojau will also not be liable for interruptions arising from decisions made by Meta, OpenAI, infrastructure providers, telecommunications operators or other third parties over which it has no control.
